The University Place condominiums, 1991–1993

In 1991 Northside residents and student environmentalists opposed University Place, a student condominium complex off Clark Road, and the Chapel Hill Town Council denied its permit. The Bradley Company sued, and in 1993 the N.C. Court of Appeals reversed the denial; the town sought review by the state Supreme Court.

1991–1993 Filed under Growth, Land & Planning 4 dated events

University Place was a proposed condominium complex for students on 14 acres off Clark Road in the Bolin Creek area beside Northside. On October 21, 1991 about a dozen members of the Student Environmental Action Coalition marched to the Chapel Hill Town Hall before a public hearing on it, and residents who filled the chamber cited traffic, parking for some 400 occupants, the clear-cutting of woods and leaks in OWASA's Bolin Creek sewer interceptor. Town Manager Cal Horton had recommended a permit with conditions. On November 25 the Town Council voted unanimously to deny the special-use permit; council member Joyce Brown said the town needed housing for low-income residents instead.

On December 23 the Roanoke-based Bradley Company sued the town to overturn the denial, arguing through Chapel Hill attorney Michael Brough that it was arbitrary because the land was zoned for multifamily housing; neighbors said they hoped the denial would stand. A three-judge panel of the N.C. Court of Appeals unanimously reversed the denial, finding the town had relied on speculation rather than fact, and by October 8, 1993 the council had asked Town Attorney Ralph Karpinos to petition the N.C. Supreme Court for review.
