The Bell's hamburger stand and the appearance commission, 1965

In 1965 the Bell's chain of Charlotte planned a walk-in hamburger stand on the lot beside the Baptist church at Franklin and Columbia streets. The aldermen urged the owners not to build it, the church appealed the building permit, and the General Assembly let Chapel Hill create an appearance commission, though not in time to reach the stand. By May Bell's was reported to be negotiating a sale of the lot to the church.

1965 Filed under Growth, Land & Planning 3 dated events

On March 8, 1965 the Chapel Hill aldermen unanimously adopted Alderman Roland Giduz's resolution urging the owners of the lot beside the Baptist church at Franklin and Columbia streets not to build the walk-in hamburger stand planned there by the Bell's chain of Charlotte, though the town attorney said nothing in the zoning ordinance could stop it. On March 23 the aldermen backed a local bill to let the town set up a commission with power over the outside appearance of buildings in designated parts of town. On April 14 the building inspector issued Bell's its permit, and three lay leaders of University Baptist Church appealed it to the Board of Adjustment the same day, arguing that the stand lacked adequate parking and would injure and devalue the church property. The General Assembly passed the appearance commission bill the next day, but the act was not retroactive and did not reach the stand. The board's May 3 hearing was put off while Bell's was reported to be negotiating a sale of the lot to the church.
